Terms of Service

Draft for counsel review · Last updated September 2026 · Placeholders are highlighted

These Terms of Service (the "Terms") are a contract between you and [Entity name], a [Texas] [limited liability company] ("Novelop," "we," "us"). They govern the Novelop apps and website (together, the "Service"). By creating an account or using the Service you agree to these Terms, our Privacy Policy and our Content Policy. If you publish on the Service, the Author Agreement also applies to you.

Plain-language summary (not a substitute for the Terms): you can read the first three chapters of any book free; members get six unlocks a month, plus the Classics shelf free, and unlocked books stay yours; unlocks and purchases are final, which is why every book's first chapters are free to try; we don't store your card details; every book carries an honest label about how it was made; and if we ever disagree, we'll try to sort it out with you directly before anyone goes to court.

1. Who can use the Service

You must be at least 13 years old to create an account, and at least 18 to view content marked mature (18+). If you are under 18, you may use the Service only with the involvement of a parent or guardian who agrees to these Terms. If you are using the Service for an organization, you represent that you have authority to bind it. We may refuse, suspend or close accounts that break these Terms.

2. Your account

You sign in with Apple or with an emailed link; there is no password to remember, so keep your email and Apple ID secure — you are responsible for everything that happens under your account. Give us accurate information and keep it current. One account per person. You can delete your account at any time from Account in the app; deletion removes your profile, library, reading progress, ratings and any books you published, and it cannot be undone (see the Privacy Policy for what we retain and why).

3. Reading: samples, the Reader plan, unlocks and purchases

Samples. The first chapters of every book (currently three) are free to read, with or without an account.

Reader plan. The Reader plan is a subscription that gives you a number of unlocks each billing period (currently six per month, whether you pay monthly or yearly). One unlock opens one whole book. Unused unlocks roll over while your plan is active, up to a cap (currently 18). Unlocks are for your personal use, have no cash value, cannot be sold or transferred, and expire when your plan ends, except that books you have already unlocked stay in your library — see "Yours to keep" below.

Extra unlocks and single books. You can buy packs of extra unlocks (which do not expire) and, whether or not you are a member, buy individual books at the price the author sets.

Yours to keep. When you unlock or buy a book, we grant you a personal, non-exclusive, non-transferable license to read that book through the Service for as long as the Service exists, even if you cancel your plan. You may download it for offline reading in our apps. You may not copy, extract, share, resell, publicly perform, scrape or otherwise use the text outside the Service, or circumvent any technical limits we use to protect it. If an author unpublishes a book, it stays in the libraries of readers who already have it.

All unlocks and purchases are final. Because you can read or listen to the first chapters of every book before deciding, unlocks are not returnable and purchases are not refundable, except where the law requires or where we charged you in error. When you unlock or buy a book you ask us to make it available to you immediately, and you acknowledge that, where a statutory right to cancel a digital-content purchase exists, it is lost once we do. Authors are paid on every unlock and sale, which is why we don't reverse them.

Audiobooks. Some books also have an audiobook edition, uploaded by the author and labeled AI-narrated or Narrated by a named person. The sample chapters are free to listen to. An audiobook costs two unlocks (or one added to a book you already unlocked), or the price the author sets (currently $4.99 to $14.99, less if you already own the text) — either way the text comes with it, on the same "yours to keep" terms, and you may download it for offline listening in our apps. You may stream or download it for personal listening only, and may not extract, share, publicly perform or redistribute the audio. Audiobook unlocks and purchases are final in the same way as text.

Free books and promotions. From time to time we make a book free for a limited period. Opening it adds it to your library at no charge, on the same "yours to keep" terms.

Changes. We may change the number of unlocks per period, the rollover cap, prices and the length of samples. Price changes to an existing subscription take effect at the start of your next billing period, and we will tell you at least 30 days in advance. Changes that reduce what a plan includes will not apply to a period you have already paid for.

4. Billing, renewal, cancellation and refunds

Where you pay. In our iOS app, subscriptions and purchases are billed by Apple through your Apple ID and are governed by Apple's terms; on the web they are billed by Stripe. In both cases the card or bank details are collected and stored by Apple or Stripe, not by us.

Automatic renewal. The Reader plan renews automatically at the end of each period (monthly or yearly, as you chose) at the then-current price, until you cancel. You will be charged at the start of each new period.

How to cancel. If you subscribed in the iOS app, cancel in your Apple ID subscription settings (Settings › your name › Subscriptions). If you subscribed on the web, cancel from Account › Manage subscription, which opens your billing portal, or by emailing support@example.com. Cancellation takes effect at the end of the current period; you keep your unlocks and access until then, and unlocked books stay yours afterwards.

Refunds. Subscription fees are not refundable for partial periods except where the law requires. Purchases made through Apple are refunded by Apple under Apple's policies — request one at reportaproblem.apple.com. Web purchases of books and audiobooks are final (Section 3); we always refund charges made in error or duplicate charges, and we consider other requests case by case at our discretion. Nothing in this section limits rights you have under the consumer laws where you live.

Free trials and introductory offers. If we offer a trial or introductory price, we will tell you the price you will pay when it ends and when that will happen. You can cancel before the trial ends to avoid being charged.

Taxes. Prices may be shown without sales tax; where tax applies it is added at checkout and collected by Apple or Stripe on our behalf.

5. Books, labels and what we don't promise

Books on the Service are written by independent authors — by people, with generative AI, or both — and reviewed by our moderators before they go live. Each book carries a label chosen by its author — Human-written, Human-written · AI-assisted, AI-drafted · human-edited, or AI-written · human-curated — and, where AI was used, names the models; audiobooks likewise say whether the narration is synthetic or by a named person. We require the labels to be accurate and we check what we can, but we do not independently verify every claim. Books are works of fiction; nothing in them is advice. We do not guarantee that any book is free of errors, that it will be available forever, or that it will suit you.

We are not the author or publisher of user-submitted books and, to the fullest extent permitted by law (including 47 U.S.C. §230), we are not liable for their content. If a book breaks our Content Policy, report it from the book page and a person will review it.

6. Acceptable use

You agree not to: (a) copy, scrape, extract, redistribute or train machine-learning models on book text or any other part of the Service; (b) circumvent samples, unlocks, geographic or age restrictions, or any security measure; (c) share accounts or resell unlocks; (d) post ratings or reviews that are fake, paid for, or that you were asked to post by the author; (e) harass, threaten or dox anyone; (f) upload malware, spam or anything that interferes with the Service; (g) impersonate any person or misrepresent your affiliation; or (h) use the Service for anything unlawful. We may remove content and suspend or terminate accounts that break these rules, and we may report unlawful conduct to authorities.

7. Ratings and reviews

Only readers who have unlocked a book and read at least a quarter of it can rate it, and reviews show a "verified read" mark. Reviews must be your own honest opinion of the book. Authors may not rate their own books, trade reviews, or pay for them. By posting a review you grant us a worldwide, royalty-free license to display it with the book and in our marketing, with your display name. We may remove reviews that break these Terms or the Content Policy.

8. Intellectual property

Authors own their books and license them to us under the Author Agreement. The Service itself — its software, design, name, logos and editorial content — belongs to us or our licensors and is protected by copyright, trademark and other laws. Except for the reading license in Section 3, these Terms give you no right to use any of it. Feedback you send us may be used without obligation to you.

9. Copyright complaints (DMCA)

We respond to notices of claimed infringement under the Digital Millennium Copyright Act. Send notices to our designated agent: [Agent name], [postal address], dmca@example.com, [phone]. A notice must identify the copyrighted work, identify the material you say infringes it and where it is on the Service, include your contact details, a statement that you believe in good faith the use is not authorized, a statement under penalty of perjury that the notice is accurate and that you are authorized to act for the owner, and your physical or electronic signature. We will remove or disable access to material that is the subject of a valid notice, notify the author, and forward counter-notices as the DMCA provides. We terminate the accounts of repeat infringers.

10. Ending things

You can stop using the Service or delete your account at any time. We may suspend or terminate your account if you materially breach these Terms, if we are required to by law, or if we discontinue the Service; where practical we will give you notice and, if we discontinue the Service entirely, at least 60 days to download your books in a form we make available. Sections that by their nature should survive (licenses you granted, disclaimers, limitations, disputes) survive termination.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT ANY BOOK WILL BE ACCURATE, COMPLETE OR AVAILABLE FOR ANY PERIOD. Some jurisdictions do not allow these disclaimers, so some may not apply to you.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR OFFICERS, EMPLOYEES, CONTRACTORS AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE AND (B) US $100. These limits do not apply to liability that cannot be limited by law.

13. Indemnity

You will defend and indemnify us against claims, damages and reasonable costs (including attorneys' fees) arising from your breach of these Terms, your misuse of the Service, or content you submit — to the extent permitted by the law where you live.

14. Disputes

Talk to us first. If you have a problem, email support@example.com. Most issues can be fixed in a day or two. Before starting any formal proceeding, you and we agree to try in good faith to resolve the dispute informally for at least 30 days after one of us notifies the other in writing.

Governing law and venue. These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Subject to the arbitration clause below, any dispute will be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to their jurisdiction, except that either of us may bring an individual claim in small-claims court.

[Optional — decide whether to include: Binding arbitration. Any dispute that cannot be resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Austin, Texas, with the arbitrator applying these Terms. Class actions and class arbitrations are waived. You may opt out of this clause by emailing us within 30 days of first accepting these Terms. Note: the AAA's consumer fee schedule and mass-arbitration rules should be reviewed before adopting this clause.]

Time limit. To the extent permitted by law, any claim must be brought within one year after it arose.

15. Additional terms for the iOS app

These Terms are between you and us, not Apple. Apple has no obligation to provide maintenance or support for the app and is not responsible for any claim relating to it, including product liability, consumer protection, intellectual property and legal or regulatory compliance claims. Apple and its subsidiaries are third-party beneficiaries of these Terms with respect to the app and may enforce them against you. You represent that you are not in a country subject to a U.S. government embargo and not on any U.S. restricted-party list. Use of the app must also comply with Apple's App Store terms.

16. Changes to these Terms

We may update these Terms. If a change is material we will notify you in the app or by email at least 14 days before it takes effect, and the new Terms will apply from that date. If you don't agree, cancel your plan and stop using the Service before the change takes effect; continuing to use the Service afterwards means you accept the change.

17. General

These Terms, the Privacy Policy, the Content Policy and (for authors) the Author Agreement are the entire agreement between you and us about the Service. If any part is unenforceable, the rest stays in force. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to a successor. Notices to you may be sent to the email on your account. Nothing here creates a partnership, employment or agency relationship.
